David Barlow Joins NAFUSA and Rejoins Sidley

David B. Barlow stepped down as the U.S. Attorney for the District of Utah this summer, and rejoined Sidley Austin as a partner in Sidley’s Washington, D.C. office and will focus his practice on the service of the firm’s life sciences clients. Barlow is also NAFUSA’s newest member.

Barlow originally joined Sidley in 2000 and became a partner in 2006. During his time at Sidley, he handled a wide variety of cases, with particular emphasis on pharmaceutical, medical device, and mass tort matters.

Barlow was nominated by President Obama and unanimously confirmed by the Senate as U.S. Attorney for the District of Utah in September 2011. Prior to his service as U.S. Attorney, Barlow served as Senator Mike Lee’s Chief Counsel on the Judiciary Committee.

In March 2013, Attorney General Holder asked Barlow to serve on the Attorney General’s Advisory Committee. Barlow also served on the Health Care Fraud Working Group, the White Collar Crime Subcommittee and chaired the Local Government Coordination Working Group.

NAFUSA Secretary Doug Jones invited his colleagues Don Stern (NAFUSA Immediate Past President) and Greg Vega (NAFUSA President Elect) to last Saturday’s Alabama- Mississippi State football game in Tuscaloosa. Jones is well known for his loyalty to the the Tide and he was not disappointed as Alabama rolled, beating the number one Mississippi State team 25-20.

On Saturday, November 8, 2014, in a ceremony at the White House, President Obama announced the nomination of Loretta Lynch to succeed Eric Holder as the Attorney General of the United States. Lynch is serving her second turn as the United States Attorney for the Eastern District of New York and is also the chair of the Attorney General’s Advisory Committee.

Lynch received her A.B., cum laude, from Harvard College and her J.D. from Harvard Law School. She joined the Brooklyn office of the Untied States Attorney in 1990, and prosecuted white collar crime and public corruption cases. She served as chief assistant to United States Attorney Zachary Carter, and was a member of the trial team in the civil rights case involving the sexual assault by New York City police officers upon Haitian immigrant Abner Louima. In the photograph below, she is shown in 1999 with Carter (left), now the New York City corporation counsel and NAFUSA board member, and Alan Vinegrad (far right), another member of the Louima trial team who also served as U.S. Attorney in the EDNY (2001-2002) and is a member of NAFUSA.

Lynch was appointed by President Clinton to succeed Carter as the U.S. Attorney for the EDNY, serving from 1999 to 2001. Before returning to a second term as United States Attorney in 2010, she was a partner in the New York office of Hogan & Harston, L.L.P.

In Saturday’s ceremony at the White House, also attended by Attorney General Holder, President Obama said Loretta Lynch “might be the only lawyer in America who battles mobsters and drug lords and terrorists, and still has a reputation for being a charming people person.”

In Sunday’s “Quotation of the Day” in The New York Times, Zach Carter said: “She really is the soul of grace under pressure.”

The White House confirmed today that President Barack Obama will nominate Lorreta Lynch, United States Attorney for the Eastern District of New York, to be the next Attorney General. Lynch, a former member of NAFUSA, is the chair of the Attorney General’s Advisory Committee, and is serving her second turn as the chief federal prosecutor in Brooklyn. The New York Times noted that

If Ms. Lynch is confirmed, it would be the first time in nearly two centuries that a president had elevated a United States attorney directly to the position of attorney general. The last time was in 1817, when President James Monroe chose William Wirt, the top prosecutor in eastern Virginia, for the job.

Lynch spoke to the NAFUSA conference last month in Boston, engaging in a dialogue with then NAFUSA President Don Stern, as shown above.  Lynch was appointed by President Clinton as the U.S. Attorney for the Eastern District of New York, serving from 1999 to 2001. Before returning to the office as United States Attorney in 2012, she was a partner in the New York office of Hogan & Harston, L.L.P. She earned her college and law degrees at Harvard.

Eric Holder announced in September that he would be stepping down as soon as his successor can be named and confirmed. Shortly thereafter, Deputy Attorney General James Cole also announced he would be leaving. NAFUSA member Joe Whitley was interviewed by CBS on September 25 about Holder’s resignation, stating that Holder was a good friend who will be remembered as having done a good job. Click here to watch Whitely’s CBS interview.

 

Ratcliffe Joins Brooks in the US Congress

In last Tuesday’s election, NAFUSA member John Ratcliffe, shown right, won a seat in the 114th United States Congress representing the 4th District of Texas. Ratcliffe served as the United States Attorney for the ED of Texas 2007-2009. He had served as the first assistant to NAFUSA President Matt Orwig, and succeeded Orwig when the latter returned to private practice. Ratcliffe is currently a partner with the Ashcroft Law Firm in Dallas.

Ratcliffe will join Susan Brooks, who was reelected to Congress to represent the 5th District of Indiana, with a whopping 65.2% of the vote. Brooks, shown left, a regular at NAFUSA’s annual conferences, served as the U.S. Attorney for the SD of Indiana 2001-2007.

 

 

 

 

 

Asas Hutchinson

Another former U.S. Attorney, Asa Hutchinson, shown right, was elected governor of the State of Arkansas. He served the WD of Arkansas 1982-1985. He also served in the U.S. House of Representatives, and was the administrator of the DEA.

Former U.S. Attorney Tom Corbett did not fare so well in last Tuesday’s election. Corbett, who served as U.S Attorney for the WD of Pennsylvania 1989-1993, was defeated in his effort to be reelected governor of the State of Pennsylvania.

 

Brower Named To Board of Trustees of International Association of Gaming Advisors

NAFUSA member Greg Brower has been appointed to the Board of Trustees of the International Association of Gaming Advisors (IAGA) at its annual meeting in Philadelphia.
IAGA is the world’s preeminent association of gaming advisors and includes senior executives, legal and financial advisors, regulators, consultants and academics. Members are involved in the evolution of regulated gaming in numerous jurisdictions worldwide, and contribute to the promulgation and progress of gaming law through publications,
conferences and teaching.

“I am honored to be joining some of the world’s best gaming lawyers on IAGA’s Board of Trustees,” said Brower. “I look forward to working with my esteemed colleagues around the globe as IAGA continues its leadership role within the international gaming community.”

Brower is a partner in Snell & Wilmer’s Reno and Las Vegas offices. His practice is focused on complex civil and white collar criminal litigation, as well as corporate investigations and administrative law, including gaming regulatory matters. His more than 20 years of practice includes significant experience as a “first chair” trial and appellate advocate, as well as service at the highest levels of state and federal government. In addition to being a partner at Snell & Wilmer, he serves in the Nevada Senate and as the Republicans won a majority of seats in the November election, Brower will become the new chairman of the Judiciary Committee. A frequent author and lecturer on gaming issues, Brower recently served on the Nevada Legislature’s Interim Committee to Study the Impact of Technology upon the Regulation of Gaming. Boston Conference Big Success

The NAFUSA annual conference was held in Boston October 9-11, 2014, and opened with a successful cocktail reception honoring Bob Mueller. NAFUSA President Don Stern contacted the Boston Red Sox after he learned that Bob was a true fan, and Red Sox Vice President David Friedman, shown below right, presented Mueller with a Red Sox jersey with his name and the number “12” representing Bob’s 12 years as the Director of the FBI and a bat autographed by the Red Sox manager, John Farrell.

One of the highlights of the conference was the presentation of this year’s J. Michael Bradford Award to John Gay, Joseph Minish and Steven Sanders of the District of New Jersey for their outstanding prosecution of United States v. Paul Begrin. Paul Fishman, the United States Attorney for the District of New Jersey was on hand for the presentation to his nominees. Bradford Award

The conference concluded with a dinner and business meeting on Saturday night featuring the keynote address by Ed Davis, former Boston Police Department Commissioner, who spoke on “Lessons Learned from the Boston Marathon Bombing”.  Don Stern turned the gavel over to Matt Orwig, the new president for 2014-2015. In the photo below, Matt is presenting Don with a gift of a new golf bag.

In addition, the membership voted the following members to offices: President Elect: Gregory Vega, SD of California; Vice President: Bart Daniel, District of South Carolina; Secretary: Doug Jones, ND of Alabama; and Treasurer: Terry Flynn, WD of New York. The newly elected directors for the class of 2017 were: Zach Carter, ED of New York; Karen Hewitt, SD of California; Chuck Stevens, ED of California; Bob Miller, District of Colorado; and Neil MacBride, ED of Virginia.

Matt Orwig closed the meeting by promising to organize a great conference next year to be held at The Phoenician in Scottsdale, Arizona on October 15-18, 2015.
